The topic of internet intermediary liability is currently a hot topic in internet governance. An internet intermediary can simply be defined as a platform that facilitates communication or interaction among its users via the internet. However, beyond this simple description, defining exactly what an internet intermediary is—along with the responsibilities and obligations attached to them—remains a distinct challenge.
Due to its sensitive and personal nature, personal data must be protected—not only by its owners but also by the state through the regulations it enacts. The Personal Data Protection Act is seen as an instrument capable of striking a balance between innovation, the economy, and the protection of personal data in the digital realm.
The Pusaka Bentala Rakyat Foundation and the Tifa Foundation view this protection guide for environmental human rights defenders as an urgent necessity. Pada Rabu, 12 Mei 2021 lalu, sebuah akun di Raid Forums dengan nama pengguna Kotz merilis 240 MB sampel data pribadi dari satu juta penduduk Indonesia. Data tersebut diklaim berasal dari data kependudukan yang disimpan oleh BPJS Kesehatan. Kasus ini baru mencuat ke publik pada Kamis, 20 Mei 2021 dengan perkiraan total kebocoran data sebanyak 279 juta data penduduk Indonesia, yang juga dijual di Raid Forums.
